0. PURPOSE

These General Terms and Conditions regulate the purchase of products offered on the website gabsystem.com, owned by GAB SISTEMATICA ANALITICA SL (hereinafter, GAB SISTEMATICA ANALITICA).

The purchase of any product implies full and unconditional acceptance of each and every one of these General Terms and Conditions, without prejudice to the acceptance of any Specific Terms and Conditions that may apply when purchasing certain products.

These General Terms and Conditions may be modified without prior notice; therefore, it is advisable to read their contents carefully before proceeding with the purchase of any of the products offered.

All notifications and communications between users and GAB SISTEMATICA ANALITICA shall be considered effective for all purposes when made through any of the means detailed above.

3. PRODUCTS

The products offered, together with their main characteristics and prices, are displayed on screen.

GAB SISTEMATICA ANALITICA reserves the right to decide, at any time, which products and/or services are offered to customers. Therefore, GAB SISTEMATICA ANALITICA may at any time add new products and/or services to those currently offered. Likewise, GAB SISTEMATICA ANALITICA reserves the right to withdraw or stop offering any products at any time without prior notice.

Notwithstanding the above, the purchase of certain products may only be made through USER subscription or registration, whereby GAB SISTEMATICA ANALITICA will provide the interested party with a username and password that will personally identify and enable access to the products.

Once on gabsystem.com, and in order to purchase the various products, the User must follow all the instructions indicated during the purchase process, which will imply the reading and acceptance of all general and specific terms and conditions established on gabsystem.com.

4. AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

GAB SISTEMATICA ANALITICA aims to guarantee the availability of all products advertised through gabsystem.com. However, if any requested product is unavailable or out of stock, the customer will be informed by email as soon as possible. Furthermore, during the purchase process, information regarding product stock availability will be provided.

If the product is unavailable and the consumer has been informed thereof, GAB SISTEMATICA ANALITICA may provide a product with similar characteristics at no additional cost, in which case the consumer may accept or reject it by exercising their right of withdrawal and contract termination.

In the event of unavailability of all or part of the order, and if the customer rejects the substitute products, any amount previously paid will be refunded to the account indicated by the customer, except in the case of card payments, where the charge will be cancelled.

If GAB SISTEMATICA ANALITICA unjustifiably delays the reimbursement of amounts paid, the consumer may claim double the amount owed.

5. PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase on gabsystem.com, the customer must be of legal age.

Additionally, the customer must register on gabsystem.com by completing a data collection form providing GAB SISTEMATICA ANALITICA with the information necessary for contracting. In any case, the data provided must be truthful, accurate, and complete regarding the customer’s identity, and the customer must expressly consent to such processing by accepting GAB SISTEMATICA ANALITICA’s privacy policy.

The steps to complete a purchase are as follows:

6. DURATION, RENEWAL, AND CANCELLATION OF THE CONTRACT

RENEWAL

There is no renewal.

CANCELLATION

Orders cannot be cancelled once the shipping process has started.

If 15 days have passed since the order date and the corresponding bank transfer has not been received, the order will be cancelled without obligation for either party.

7. DELIVERY

PRODUCTS

The order will be delivered to the address designated by the customer at the time of purchase according to the selected shipping method.

Delivery areas include: Balearic Islands, Canary Islands, Mainland Spain, Portugal, and European Union countries.

DELIVERY METHODS AND TIMES

1. Shipping

The shipping process will not begin until advance payment has been received via Bank Transfer, Credit Card, PayPal, or Bizum.

The delivery time for each item will depend on its availability and the shipping destination.

Estimated delivery time is 24–48 hours within mainland Spain and 48–72 hours to the Balearic Islands. In the case of the Canary Islands, the estimated delivery time is 7 days, and approximately 15 days internationally, excluding Saturdays, Sundays, and public holidays. Deliveries are made Monday to Friday only.

Upon receiving the package, please open it in the presence of the carrier to rule out possible damage.

2. In-store collection

You may collect your order in-store.

3. European Union countries

Delivery time will be communicated to the customer during the purchase process.

8. PRICES, FEES, AND TAXES

The prices of products listed on gabsystem.com are expressed in Euros unless otherwise stated and are guaranteed during their validity period, except in the case of printing errors and regardless of the order destination.

PRODUCTS

The final prices of all products (and, where applicable, final prices per unit of measurement when mandatory), together with their characteristics, offers, discounts, etc., are reflected in each item appearing in the gabsystem.com catalogue.

• Prices do not include VAT.
• VAT is charged at 21%. European Union countries and the Canary Islands registered as intra-community operators are exempt from paying this tax (customs duties and import taxes may apply).
• Shipping costs: These will be informed during the purchase process.

Product prices may change at any time. In such cases, the applicable price will be the one in force on the order date. In any event, the final cost will be communicated to the customer during the electronic purchase process before acceptance is formalized.

9. PAYMENT METHODS

We offer the following payment methods:

a. Credit or debit card

Payment can be made immediately through our bank’s secure SSL payment gateway. If any refund or order cancellation is necessary, the amount will be reimbursed to the same payment card.

b. Bank transfer

By cash deposit or bank transfer to:

c. PayPal

Payment authorization will be made through PayPal, but no money will be withdrawn until PayPal verifies that the transaction is correct. A PayPal account is required.

Payment can be made immediately through Bizum. If any refund or order cancellation is necessary, the amount will be reimbursed to the same number used for the Bizum payment.

NOTES

If 15 days have passed since the order date and the corresponding transfer has not been received, the order will be cancelled without obligation for either party. Once shop.gabsystem.com becomes aware of the payment through the bank, shipment will proceed. Please note that bank transfers are not effective until 24 working hours after the deposit. Customers may speed up this process by sending proof of the bank transfer by email to gab@gabsystem.com or by fax to +34 93 817 14 36, always indicating the order number.

10. RETURNS AND WITHDRAWAL POLICY

According to current regulations, consumers and users have the right to WITHDRAW from the contract within a maximum period of 14 calendar days without giving any reason and without incurring any costs, except those provided for in Articles 107.2 and 108 of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users.

This right of withdrawal does not apply, among others, to:

• Contracts for the supply of goods made to the consumer’s specifications or clearly personalized goods, or goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly.
• Supply of sealed goods not suitable for return for health protection or hygiene reasons.
• Supply of goods which, after delivery, have been inseparably mixed with other items.

PRODUCTS

The customer shall have a maximum period of 14 calendar days from the day of receipt of the goods or requested product to inform GAB SISTEMATICA ANALITICA of their wish to withdraw from the contract.

Withdrawal implies that GAB SISTEMATICA ANALITICA will refund the amount already paid by the customer within a maximum period of 14 calendar days, using the same payment method chosen by the customer.

During this period, the consumer shall communicate their decision to withdraw from the contract by completing the form found at the end of this document and sending it to GAB SISTEMATICA ANALITICA’s email address.

GAB SISTEMATICA ANALITICA shall acknowledge receipt of the withdrawal on a durable medium.

To process a return, the product must be in perfect condition, with its original packaging, all accessories included, and unused.

Once we receive your request, we will contact the customer to provide return instructions.

The customer shall bear the return shipping costs.

NOTES

Returns sent carriage forward will not be accepted unless expressly authorized by us. Returns will not be accepted if the product is not sent in perfect condition and in its original packaging. Once the goods have been received and verified to be in perfect condition, the refund will be processed.

11. WARRANTY

Products purchased through gabsystem.com benefit from a warranty period from the date of purchase, covering possible manufacturing defects and any breakdowns occurring during said period.

Consumable products, defects caused by improper use or handling, connection to an incorrect electrical supply, incorrect installation, or defects resulting from external causes are excluded from the warranty.

For durable goods, consumers shall be entitled to adequate technical service and the availability of spare parts for a minimum of 5 years from the date the product ceases to be manufactured, without any increase in spare part prices when applied to repairs.

To avoid installation or handling problems with the purchased product, please ensure that you have followed the installation and operating instructions contained in the user manuals.

If the purchased product still does not function correctly, you should immediately contact the manufacturer’s customer support and technical assistance services, or, where applicable, the representative or distributor.

Technical services will usually require the following information:

• Invoice number
• Specific model identification
• Serial number

NOTES

Products benefit from the warranty provided by the respective manufacturers of each item. Defects or damage caused by improper use or handling of the material, or wear and tear resulting from normal use, are not covered by this warranty. Consumable materials and glass materials are also excluded.

12. LIABILITY AND DISCLAIMER OF LIABILITY

Consumers and users are entitled to repair of the product, replacement, price reduction, or termination of the contract, as established in Chapter II, Title IV, Book II of the General Law for the Protection of Consumers and Users.

If the product does not conform to the contract, the consumer may choose between repair or replacement of the product, both of which shall be free of charge to the consumer and carried out within a reasonable period depending on the nature of the products and their intended purpose.

If, after repair and delivery, the product still does not conform to the contract, the consumer may demand replacement, a price reduction, or termination of the contract.

14. APPLICABLE LEGISLATION

These conditions shall be governed by current Spanish legislation.
